<p>For several years LSAT students across the country have been defrauded by a Houston business passing itself off as our company. Students visiting the <a rel="external nofollow" target="_blank" href="http://www.testmasters.com" target="_blank">www.testmasters.com</a> website—which is controlled by the Houston company—often mistake it for our website <span id="more-8"></span>and pay over $1000 each to enroll in the LSAT courses advertised on the site. These students think they are signing up for the TestMasters LSAT Course but end up getting &#8220;the worst course on the market&#8221;, to quote one of the confused consumers. When students discover that they have signed up for the wrong course and seek refunds, the Houston company either refuses to give the students their money back or requires that the students sign legal waivers and gag orders in exchange for refunds. </p>
<p>TestMasters has created the website <a rel="external nofollow" target="_blank" href="http://www.duanemorriscommitsmalpractice.com"><a rel="external nofollow" target="_blank" href="http://www.duanemorriscommitsmalpractice.com" target="_blank">www.duanemorriscommitsmalpractice.com</a></a> to inform consumers about this scam and its underlying causes. The site reveals how one of the country’s largest law firms—<a rel="external nofollow" target="_blank" href="http://www.duanemorriscommitsmalpractice.com">Duane Morris</a>—enabled the Houston business to cheat aspiring lawyers out of their time, their money, and in many cases, their futures.</p>

<p>On May 22, 2007, Duane Morris attorney Felice Schonfeld telephoned the TestMasters office and spoke to one of our customer service representatives. Ms. Schonfeld was seeking to enroll two of her sons in the TestMasters LSAT course, but previously had been misdirected to the imposter company. She began the conversation by stating that she was &#8220;very confused.&#8221; When Ms. Schonfeld learned that two different LSAT preparation companies with the same name were operating in the same geographic markets, she described the situation as &#8220;awful… I have never seen anything like this… This is terrible.&#8221; She then went on to proclaim, &#8220;You’ve got confusion here… I’m a trademark attorney, for God’s sake. There’s nobody that’s going to be less confused than me, and I was confused. You’ve got the worst confusion situation, frankly, that I have ever seen in my thirty years of practicing.&#8221; Ms. Schonfeld correctly observed that TestMasters is suffering great damage as a result of the confusion: &#8220;You’re losing, I am sure, a tremendous amount of income here.&#8221;</p>
<p>&#8220;Get outta here—where’s your trademark attorney?&#8221; asked Ms. Schonfeld. That’s exactly what I was wondering when I found out about the Fifth Circuit’s decision. No one at Duane Morris informed me of the decision until six days after it was rendered, and by that point the deadline to file an emergency en banc appeal had drawn dangerously near. When I demanded to speak to Mr. Redano, I was told that he had gone to Alaska on a two-week fishing trip the day after he had learned of the Fifth Circuit’s decision. I tried repeatedly to contact Mr. Redano, but like a coward he refused to take my calls. As a result, we had no choice but to hire a different law firm at the last minute to file the emergency appeal. After collecting almost one million dollars in attorneys’ fees, Mr. Redano was suddenly nowhere to be found. Having lost our federal trademark and put our company’s future in jeopardy, he decided it was time to hang the Gone Fishin’ sign on his office door. Apparently we were no longer of any use to Mr. Redano.</p>
<p>This untenable situation—in which two different LSAT preparation companies are operating under the same name in 48 states—is precisely what trademark law is designed to prevent. Had Duane Morris provided TestMasters with competent legal representation, this situation would never have arisen. If our federal trademark had been upheld, the imposter company would have been legally precluded from using the TestMasters name outside of Texas. In addition, since we would have gained control of the <a rel="external nofollow" target="_blank" href="http://www.testmasters.com" target="_blank">www.testmasters.com</a> domain name, the imposter company would not have been able to use that domain name to deceive consumers on the internet. Since the Fifth Circuit’s ruling in 2002, TestMasters has spent millions of dollars in attorneys’ fees in an attempt to remedy the situation, but to no avail. The federal courts have projected the Fifth Circuit’s ruling indefinitely into the future, taking the position that we can never establish trademark rights because we failed to do so back in 2001. As hard as we try, we can never seem to get out from under the wreckage that has resulted from Mr. Redano’s malpractice.</p>

<p> If you are already in law school, I’m sure you’ve heard that your first year of law school is the most important year of your legal education.  Indeed, your 1L grades may very well determine your career path.  For instance, I started law school believing that I would probably end up working for the government.  After doing well as 1L, however, my career path completely shifted and I now work for an international law firm.</p>
<p>In this a<span id="more-6"></span>rticle, I am going to outline a few simple steps you can take to succeed as a 1L:</p>
<ul>
<p></p>
<li>While reading cases, focus on the big picture.  Try to understand why you are reading this case and how it fits into the big picture.  You don’t need to worry about every small fact of the case.  Just know the main point/principle that comes out of the case and that is what you’re going to need for your final exam.</li>
<p></p>
<li>Attend every class and take thorough notes.  Your professor is the one who is going to prepare the final exam and it is very unlikely that he/she is going to cover some subject in the final that he/she did not cover in class.</li>
<p></p>
<li>Avoid study groups.  Seriously, study groups are a waste of time.  Law students, especially 1Ls, love to argue about stupid stuff and many times, study group members end up wasting valuable hours arguing about some stupid principle that may or may not be covered in the exam.  Instead, have a couple of reliable friends and when you are having trouble understanding some case on your own, ask your friends or the professor for help.</li>
<p></p>
<li>Prepare attack outlines.  Seriously, do you think you would have the time to memorize that 200-page outline of yours?  Try preparing short outlines (25-50 pages) and memorize these outlines like crazy!</li>
<p></p>
<li>Avoid competing.  Seriously, it is not healthy for you.  Try to compete with only yourself and keep a positive attitude.  Last thing you want is to freak out during an exam because you are so eager to kick everyone’s ass.</li>

<p>This list is not exhaustive and I’m sure what worked for me may not work for everyone.  But still, if this helps you out even a little bit, I would consider the 30 minutes it took for me to write this article as time well spent.</p>

<p> It seems that many people dream of one day becoming a high profile lawyer, setting lofty goals for themselves as they move forward through school.  However, without knowledge of how to get into law school and what to expect while there, those dreams can never become a reality.  Where does an aspiring law student start?  To whom should you turn for more information?</p>
<p>The best place to start your path to law school is by speaking with a prela<span id="more-5"></span>w advisor.  Your advisor can be found at your undergraduate institution and would be happy to help you determine whether or not you are a candidate, where you should apply, and what course you should follow to achieve your goal.</p>
<p>Law school is not for everyone.  Critical thinking and writing abilities are required, as well as a feeling for the humanities (social sciences, natural sciences, art, and other things affecting human experience).  An education in logical reasoning, written and oral expression, and critical analysis provide a good basis for acceptance to law school, regardless of your major.  Excellent performance and rigorous course schedules are very important in providing an acceptable educational history to a law school.</p>
<p>Law school will equip you to analyze legal issues and stay abreast of the continuously changing laws and policies.  A lawyer must be able to think on his or her feet and adjust to the evolving legal environment in which they must function.  Lawyers must be able to provide useful and intelligent counsel to individuals regarding the law and its functionality.  Clear speaking and writing abilities are also a must.  Law school will prepare you for all of the aspects of being a lawyer, as well as teaching the arts of persuasion and negotiation, which also become a large part of a law career.</p>
<p>There is no specific curriculum that a law school follows; they do vary from school to school.  However, most states require a lawyer to have graduated from an American Bar Association approved law school in order to earn admission into the bar.  These schools provide the basic information and training necessary to take and pass the bar exam.  Typically, states require a law student to attend the law school institution for at least three years full time or four years part time.  Most law schools, though providing training for different sorts of legal professions, gear their curriculum toward training a lawyer, though some have special programs that gear the learning experience toward a combination of law and other topics, such as business, science, technology, or public administration.</p>
<p>Many law schools will start out their first year students with subjects such as civil procedure, contracts, criminal law and procedure, constitutional law, property law, legal writing, and tort.  Eventually, in their goal of training a lawyer, the schools will place students in internships, which are used toward academic credits.  Others emphasize using the governmental and legal resources of the community for training purposes.</p>
<p>There are many questions involved in preparing for law school, and this article only touches on some of the basics.  Again, the best place to start you off on a successful career path in law is with a prelaw advisor, who can assist you in clearing up any matters not addressed here.</p>
